End User Terms and Conditions

 

The use of https://eventlink.com/ and any related branded applications operated by Eventlink, LLC, an Indiana limited liability company (“Eventlink”), is governed by the linked Terms of Use and Privacy Policy (the “General Terms”).

The following terms are supplemental to the General Terms and shall be interpreted to complement the General Terms. Any terms capitalized but not defined herein have the meaning set forth in the General Terms.

  1. Text Messaging. Text messaging may be used in connection with the Services provided through Eventlink. If you opt in to text messaging in any manner, whether by utilizing Services that are provided through text messaging, or otherwise agreeing to use text messaging in connection with the Services, you acknowledge and agree that (i) SMS (Short Message Service) will be used and you are responsible for any messages fees charged to you by your mobile phone carrier; and (ii) if you change or deactivate your mobile telephone number, you will alert us immediately. We are not responsible for text messages sent to your previous number if you fail to alert us that your number has been changed. You may opt out of receiving text messages at any time by notifying Eventlink, but certain Services may be unavailable to Users, including Accounts holders, if you opt out of receiving text messages. For clarity, your phone number is Personal Information under the General Terms and will be treated as set forth in the Privacy Policy.
  2. Advertisements. We may use the Information we collect from you, including Personal Information, to enable us to determine advertisements that may be of interest to you and to determine if you are within our advertisers’ target audience. We may contact you via text message and/or email about our own or third parties’ goods and services that may be of interest to you. If you do not want your phone number or email address to be used to promote our own or third parties’ good and services, you may either contact us or choose to opt out using the directions included in such communications when the option is presented to you. We do not sell your Personal Information for these purposes, nor do we disclose your Personal Information to the third parties whose goods and services are marketed to you; however, we may disclose your phone number and/or email address to our third party vendors and service providers who process Information on our behalf and/or send such marketing communications to you at our direction and on our behalf.
  3. Parents and Guardians. If you make an Account in order to use the Services in a manner which may reveal personally identifiable information about a student or other individual, you represent and warrant that you are the parent or legal guardian of such individual, and that you have the right to provide such personally-identifiable information about such individual.
  4. Officiants; Payment and Taxes.Eventlink offers the ability for representatives of schools (for example, athletic directors), to engage referees, umpires, and other sporting officials for school events (“Officiants”).
    1. If you are an Officiant, you acknowledge that your contact information will be shared with and available for viewing by Users of Eventlink who may want to engage you for your services. Without limiting the generality of the General Terms which require all information provided when creating an Account to be accurate, you represent and warrant that any information provided regarding your experience with officiating events, and any licensing or certification that you possess from any entity or organization is accurate and current in all respects.
    2. If you engage an Officiant for your event, you acknowledge and agree that Eventlink provides only a method to connect you with the Officiant. Officiants are not employed by, performing services for, or otherwise a representative, agent, or contractor of Eventlink. You agree to hold Evenlink harmless, and waive any claims you may have against Eventlink, arising from or related to the actions or inactions of any Officiant you identified or engaged through Eventlink. If you are an Officiant, you agree to hold Eventlink harmless, and waive any claims you may have against Eventlink, arising from or relating to the actions of any party who engages you for your services as an Officiant.
    3. Eventlink offers the opportunity for Officiants to be paid through Eventlink (“Eventlink Pay”). Eventlink Pay is provided through a third-party payment provider, Dwolla. If you use Eventlink Pay, either as a payor or payee, you acknowledge that your payment information and related information will be shared with Dwolla to the extent necessary to process your payments. You may be subject to Dwolla’s online policies and terms, which may be different from Eventlink’s policies and terms. You understand and acknowledge that you will access and manage your Dwolla account, as it relates to Eventlink Services, through Eventlink. If you have questions about Eventlink Pay, you should contact Eventlink.
    4. If you use Eventlink Pay, you may be charged a transaction fee for each transaction. By processing your payment, you agree and consent to the transaction fee set forth at the time of payment.
    5. Eventlink offers services to Users who make or receive payments using Eventlink to report the same to the Internal Revenue Service and relevant state taxing authorities (“Tax Reporting Services”). You agree that if you are being paid by a User who utilizes the Tax Reporting Services, payments made to you may be reported to relevant taxing authorities. If you use the Tax Reporting Services as a payor or payee, you may be required to provide information to complete a Form W-9, or other relevant tax forms, in order to utilize such Tax Reporting Services. Such information may include your social security number, social insurance number, driver’s license number, passport number, or other identification or insurance numbers. Such information will be included in the definition of “Personal Information” in the Privacy Policy and will be treated as set forth in the Privacy Policy and as set forth herein, including, sharing such information with relevant tax authorities.
